Bemis announced in late September 2010 that he had written and recorded a 10-song album of acoustic songs that he called Max Bemis and the Painful Splits. Bemis stressed that this release was not an official solo record, but a collection of songs he had written that he was proud of and wanted to share with Say Anything fans.

The album was the first album that was self-produced by front-man Max Bemis. Bemis worked in the studio with audio engineer Garron DuPree for many months while recording the album at Bemis and Dupree's own studio in Tyler, TX. The album was mixed by mix engineer Brad Wood, and mastered by Emily Lazar.
