availability of residential real estate- related transactions. The illustrations of unlawful housing discrimination in this part may be established by a prac-tice’s discriminatory effect, even if not motivated by discriminatory intent, and defenses and rebuttals to allega-tions of unlawful discriminatory effect ma.

(1) A person is directly liable for: (i) The person's own conduct that results in a discriminatory housing practice. (ii) Failing to take prompt action to correct and end a discriminatory housing practice by that person's employee or agent, where the person knew or should have known of the discriminatory conduct.

§ 100.500 Discriminatory effect prohibited. Liability may be established under the Fair Housing Act based on a practice's discriminatory effect, as defined in paragraph (a) of this section, even if the practice was not motivated by a discriminatory intent.
